Introduction

Please read these Terms and Conditions ("Terms") carefully before purchasing from SÌORRAIDH. By accessing our website and placing an order, you agree to be bound by these Terms.

1. General Provisions

  • Age Requirement: By placing an order, you confirm that you are at least 18 years of age. We reserve the right to cancel any order where we suspect the customer is a minor.
  • Right to Refuse Service: We reserve the right to refuse service to anyone, for any reason, at any time.
  • Governing Law: These Terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.

2. Pricing, Errors & Payment

  • Pricing Errors: If a product's correct price is higher than the price stated on our website, we reserve the right to cancel your order and refund you in full. We are not obligated to provide the product at the incorrect price.
  • Currency: All prices are final. You are responsible for any banking charges or currency conversion fees.

3. International Shipping, Customs & Duties

  • Importer of Record: Products are shipped from international distribution centers. You acknowledge you are the "Importer of Record."
  • Taxes & Fees: You are strictly responsible for any applicable Import Duty, VAT, or Customs Handling Fees.
  • Refusal to Pay: If you refuse to pay customs fees and the parcel is returned or destroyed, no refund will be issued.

4. Shipping Estimates, Restrictions & Delays

  • Restricted Countries: Due to international sanctions and legal restrictions, we strictly do not sell or ship to: Iran, North Korea, Syria, Russia, Cuba, or any other country subject to UK/International trade embargoes. Orders to these locations will be cancelled immediately.
  • Standard Shipping: 6 to 10 Weeks.
  • Express Shipping: 4 to 6 Weeks.
  • Force Majeure: We are not liable for delays caused by events outside our control (e.g., strikes, weather, war).
  • Late Delivery: If not arrived in 10 weeks, contact us for a 50% partial refund.
  • Lost in Transit: If not arrived in 16 weeks, you get a 100% full refund.

5. Hygiene & Returns Policy (Strict)

Under the Consumer Contracts Regulations 2013, the right to cancel does not apply to items sealed for health protection or hygiene reasons if they are unsealed after delivery.

  • Sealed Items: You may return unopened, factory-sealed items within 14 days. You pay return shipping.
  • Opened Items: We strictly do not accept returns if the cellophane wrapping, foil, sticker, or tamper-proof seal has been broken.

6. Faulty Goods, Damages & Fraud

  • Reporting Damages (24-Hour Window): If your item arrives damaged (e.g., smashed, leaking), you must email us within 24 hours of delivery with photos. Late claims are rejected.
  • Returns for Inspection: For non-hazardous faults (e.g., nozzle failure), we may request a return for inspection. You pay postage initially. If faulty, we reimburse postage. If functional, no postage refund is given.
  • Outlet Items: Sold as seen; not eligible for returns regarding stated faults.

WARNING: FRAUD & AI DETECTION

We utilize AI-image detection software on all refund claims.

  • Zero Tolerance: Attempting to use AI-generated images, edited photos, or old images to simulate damage is Fraud by False Representation (Fraud Act 2006).
  • Action: We will report all fraudulent attempts to Action Fraud (UK Police) and Stripe.

7. Health, Safety & Allergies (IMPORTANT)

  • External Use Only: Our products are for external fragrance use only. DO NOT INGEST (DRINK). Keep out of reach of children and pets.
  • Flammable: Perfume contains alcohol. Keep away from naked flames or heat sources.
  • Allergy Warning: Fragrances may contain ingredients that cause skin irritation or allergic reactions in some individuals.
  • Patch Test: You agree to perform a "Patch Test" (applying a small amount to skin) 24 hours before full use.
  • Liability Disclaimer: To the extent permitted by law, we are not liable for any allergic reactions, rashes, medical conditions, or injuries resulting from the use, misuse, or ingestion of our products. You use these products at your own risk.

8. Intellectual Property

All content (text, logos, images) is the property of SÌORRAIDH. You may not reproduce or exploit any portion of the Service without permission.

9. Limitation of Liability & Indemnification

  • Limitation: We shall not be liable for any indirect or consequential damages. Our total liability shall not exceed the purchase price of the product.
  • Indemnification: You agree to indemnify and hold us harmless from any claim (including legal fees) arising out of your breach of these Terms or your violation of any law (including illegal resale or export).

10. Severability

If any provision of these Terms is determined to be unlawful, the remaining provisions shall remain in full force and effect.
